O R D E R
% 07.09.2018 This petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the „Act‟) has been filed by the petitioner seeking appointment of an Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the Leave and Licence Agreement dated 01.07.2017. The said Agreement contains an Arbitration Agreement in form of Clause 28 thereof which is reproduced hereinunder: "'28. That in case of any dispute arising or accruing in respect of this Leave and License Agreement, the same shall be referred for arbitration in consonance with the provision of Indian Arbitration and Conciliation Act as may be amended from time to time, and such arbitration shall be held at New Delhi and conducted in English language. The law governing the arbitration proceedings shall be Indian Law."
The disputes having arisen between the parties, the petitioner invoked the Arbitration Agreement vide notice dated 14.03.2018. Having received no response, the present petition was filed.
During the course of these proceedings, an attempt was made by the parties to arrive at an amicable settlement, however, the same has failed. Learned counsel for the respondent submits that the respondent has no objection on the appointment of an Arbitrator. I accordingly appoint Mr.Arjun Pant, Advocate, (Mob.No.9811071260, Office at: K-40, Hauz Khas Enclave, New Delhi110029) as an Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the abovementioned Agreement. The Arbitrator shall give a disclosure under Section 12 of the Act before proceeding with the reference.
The petition is allowed in the above terms, with no order as to cost. Dasti.
