O R D E R
% 20.11.2018 Charges have not been framed. The petitioner is in Judicial Custody since 07.05.2018. He has been chargesheeted without arrest. He has otherwise joined investigations and has not evaded the process of law. He is accused of kidnapping and violating the body of the complainant's minor daughter thus rendering him liable under the provision of sections 363 and 376 IPC read with provisions of the POSCO Act, 2012. However, in view of the fact that the petitioner has joined investigations and has not evaded the process of law and the chargesheet has been filed without his arrest and also in view of his submission that he would continue to appear before the Court as and when required and will not evade the process of law or otherwise will not try to contact the complainant or her daughter or influence the trial proceedings in any way, the petitioner is granted bail on his furnishing a personal bond of Rs.35,000/- with two sureties of the like
amount to the satisfaction of the Trial Court, subject to the following conditions:- (i) the petitioner will regularly appear on each and every date of hearing to be fixed by the Trial Court concerned;
(ii) the petitioner will not try to influence, contact or meet the complainant and prosecution witnesses in any manner; (iii) the petitioner will not leave the country without prior permission of the Court and the passport, if any, shall be deposited with the Trial Court concerned; and (iv) the petitioner shall furnish his mobile telephone number and the residential address to the jurisdictional SHO; he shall keep the said phone number operational at all times;
(v) in case of change of his new address or contact number, the petitioner will promptly intimate to the SHO/IO of the case and intimate the Trial Court.
The petition stands disposed-off in the above terms. The Registry is directed to send a copy of this order to the Jail Superintendent, concerned for compliance. Additionally, a copy of the same shall also be given dasti to the petitioner, under the signature of the Court Master.
