% 29.03.2017 Crl.M.A. NO. 5409/2017 Exemption allowed subject to just exceptions. W.P.(Crl.) NO. 966/2017 and Crl.M.A. 5408/2017 The petitioners have filed the present petition seeking quashing of FIR No.322/2016 registered on the complaint of the complainant under Sections 420/34 IPC against the petitioners at Police Station - Ashok Vihar The complainant is present in Court. He is identified by the Investigating Officer. The parties have arrived at a settlement on 17.08.2016, which has been placed on record. Under the settlement, out of

the total settlement amount of Rs. 55,00,000/-, the complainant has already received an amount of Rs.40 lacs. An amount of Rs.15 lacs has been tendered to him in Court today by way of demand drafts. The complainant states that he has not been subjected to any pressure or coercion and that he has entered the settlement out of his own free will. The complainant further states that he joins the prayer for quashing of the FIR in question. The petitioners state that they are remorseful of their conduct and that they are willing to atone for the same. They state that the court may subject them to such terms and conditions as it deem appropriate. Accordingly, no useful purpose would be served in proceeding further with the FIR in question and the proceedings emanating therefrom. The same are hereby quashed subject to payment of costs of Rs. 10,000/- to be paid by each of the petitioners in the Delhi High Court Bar Association Library Fund within two weeks.
