As per office note, petitioner has filed the affidavit. Learned counsel for petitioner submits that pursuant to the letter issued by the registry, he has been asked to furnish complete details along with the valuation of the moveable properties as mentioned in the Will dated 09.06.1992 exhibited as Ex. PW-1/2. Learned counsel for petitioner through affidavit dated 05.11.2024 submits that after the death of the testator on 03.10.1993, his surviving wife took charge of entire moveable assets of the deceased and utilized them as per her wishes and as on the date of filing of the instant probate petition i.e, 28/09/2010, none of the moveable assets of the deceased testator were in existence and it was for the said reasons only, the Schedule of Properties filed along with The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the instant probate petition contained no details of moveable assets of the deceased Testator-Major M.S.N. Dutt. The affidavit is accepted. Registry is directed to proceed further so as to compute Court Fee as per law.
