% 19.07.2016 This petition has been preferred by the petitioner to seek parole in case FIR No. 538/95, PS Vasant Kunj under Sections 302/395/411, FIR No. 509/95, PS Vasant Kunj under Sections 302 and FIR No. 76/96 PS CR Park under Sections 302/397/411, for a period of 8 weeks. The reasons for seeking parole stated by the petitioner are that he needs to re-connect with the Society and also to find a match for his 24 year old unmarried daughter. The petitioner is a patient suffering from HIV and he has been taking treatment at Safdarjung Hospital.
The status report discloses that while rejecting the application for parole vide order dated 11.05.2016, the government treated the case as one of a prisoner who is convicted of murder and rape, however, that is not the position. The factual position is that the petitioner has been convicted, inter alia, of murder on three different occasions. The petitioner has already
undergone about 20 years and 3 months.
The nominal roll shows that the petitioner has been granted parole on 9 occasions earlier starting from 2008 onwards. The last time, he was granted parole was between 09.07.2015 and 10.08.2015. Nearly a year has gone thereafter. The petitioner's address and status of his family has been got verified. It is reported that his wife and one unmarried daughter are living at the address provided by the petitioner. Jail conduct of the petitioner is found to be satisfactory for the past one year. In these circumstances, the petition is allowed and the petitioner is directed to be released on parole for a period of four weeks upon his furnishing a personal bond with one surety in the sum of Rs. 10,000/- to the satisfaction of the jail superintendent. At the time of his release, he shall furnish his mobile phone number and he shall keep the said mobile phone working at all the times and the same shall not be changed without the prior intimation to Jail Superintendent. He shall not leave the limits of Delhi. He shall report on every Monday at 11.00 a.m. at PS Subzi Mandi to mark his attendance.
