% 03.10.2016 The petitioner's limited claim is towards processing a final order in its refund application. This that despite remand by the CESTAT (which was confirmed by this court), no orders were made in respect of its refund claim for the period in question i.e. 2008-2009. During the pendency of the proceedings, in the counter affidavit, the respondents have informed the court that hearing took place in respect of the refund claim on 29.08.2016 but no order has been made. The petitioner's counsel submits that instead of making an order, further documentary evidence has been sought in respect of submissions already made and documents previously furnished. The court hereby directs the respondents, especially the concerned
Assistant Commissioner, to complete the proceedings. Having regard to the materials furnished previously as well as the materials which may be hereafter furnished, make his final order on the refund claim for the period in question i.e. 2008-2009 ( in respect of tax payment between February -April 2009). Hearing shall be concluded and final orders be made latest by 30.11.2016.
The writ petition is partly allowed in the above terms Order dasti.
