The petitioner seeks bail in FIR No. 262/2017, Police Station - Nabi Karim registered under sections 186/353/332/333/34 IPC on the ground that he has been in judicial custody since 01.09.2017, two of his co-accused are already on bail. The reason for denial of bail by the Trial Court was that the nature of injury suffered by the victim is of serious nature. However, despite this Court's direction, documents showing nature of injury suffered by the injured person have not been
brought on record. It is stated that investigation in the case has been completed and charges have been framed.
In the aforesaid circumstances, the petitioner is enlarged on bail on her furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the Trial Court concerned, subject to the following conditions:- (i) the petitioner will regularly appear before the Trial Court; (ii) the petitioner will not try to influence, contact or meet the complainant and prosecution witnesses in any manner; (iii) the petitioner will not leave the country without prior permission of the Trial Court and a passport, if held by him, shall be deposited with the Trial Court; and (iv) in case of change of his address or contact number, the petitioner will promptly intimate the same to the SHO/IO of the case and also intimate the Trial Court.
Nothing stated in this order shall be deemed to be an adjudication on the merits of the case.
The petition is allowed in the above terms.
