O R D E R

% 13.09.2025 Appellant has filed an appeal for enhancement of the award dated 02.07.2013 passed by the learned MACT awarding compensation of Rs.10,35,392/- along with interest @7.5% p.a. from the date of filing of the claim petition.

We have interacted with the Ld. Counsel/parties concerned. Apropos such interaction and deliberations, parties have agreed that Respondent - CHOLAMANDALAM GEN. INS. CO. LTD shall pay Rs. 5,00,000/- over and above the award of the Ld. Tribunal. In turn, the appellant has also agreed tha the aforesaid enhanced amount shall be towards full and final settlment of all the claims involved in the appeal. It is prayed that the appeal be disposed of in aforesaid terms.

Learned Counsel for the appellant submits that appellant No.1 is the wife of the deceased and appellant No. 2 to 6 are minor through The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. their mother and natural guardian, Ms. Bhupinder Kaur, Appellant No.1. Appellant No.07 is the father of the deceased. Learned Counsel for the appellant on instructions has submitted that appellant(s) No.2 to 7 have no objection, if the enhancement amount be released to the appellant No.1 and it is assured the amount will be used for the benefit of the children.

As such, respondent - ___ CHOLAMANDALAM GEN. INS. CO. LTD is directed to deposit enhanced amount of Rs. 5,00,000/- before the learned Registrar General of this Court within a period of four weeks from today failing the respondent shall be liable to pay interest @ 9 per cent per annum for the delayed period. Learned Registrar General shall release the said amount in favour of appellant no. 1 subject to verification and completion of requisite formalities.

5. In terms of the aforesaid, the present appeal along with pending application (s) stand disposed of.

6. A copy of this order be sent to the concerned learned Tribunal with LCR, if already received.
