1. The prayer in this petition reads as under: "A. Issue a writ of mandamus directing respondents to declare that acquisition proceedings, award bearing no. 157/86-87, dated 19/09/1986 passed by the land acquisition collector, Delhi in respect of land measuring 4 Biswa out of Khasra no. 31/7, situated at Village Palam, tehsil Mehrauli, DeUii have lapsed. B. Direct Respondents not to initiate proceedings for getting physical possession of area measuring 4 Biswa out of Khasra no. 31/7, situated at Village Palam, tehsil Mehrauli, Delhi of which possession was not taken and was left due to built up area.
C. Pass such other/ further orders/ directions as this Hon'ble Court deemed fit and proper in the facts and circumstances of the case."
2. According to the narration in the petition, the notification under Section 4 of the Land Acquisition Act, 1894 ('LAA') was issued on 16th March, 1961. Subsequent to declaration under Section 6 LAA, the impugned Award was passed way back on 11th July, 1961.
3. Learned Counsel for the Petitioner seeks leave to withdraw this petition with liberty to file a fresh petition properly explaining the inordinate delay in approaching the Court for the above reliefs.
4. Dismissed as withdrawn with liberty as prayed for.
5. The interim order dated 13th July 2018 is vacated. S. MURALIDHAR, J.
