There is no appearance on behalf of the Petitioner. Even on the last date of hearing none was present to represent the Petitioner. 2.

Moreover, Mr. Naushad Ahmed Khan, learned counsel for Respondent No.1 draws the attention of the Court to the relief clause of the writ petition, wherein the Petitioner has sought extension of one year service on re-employment up to the age of 62 years with arrears of salary since 01.02.2016 and submits that the Competent Authority had passed an order dated 29.08.2016, directing the school management to cancel the reemployment of the Petitioner on the ground that he is guilty of violation of Rule 123(a)(xi) & (xii) of Delhi School Education Act and Rules, 1973. The aforesaid order according to Mr. Khan has not been assailed by the Petitioner, though the order was passed in the year 2016. 4.

Considering that the order canceling the re-employment is unassailed and the Petitioner is not present today, in my view, Petitioner is not interested in prosecuting the present matter. 5.

Petition is accordingly dismissed for non-prosecution and in default. Pending application stands disposed of.
