FAO(OS) 172/2016 & CM Nos.21398/2016 (stay), CM No.21400/2016 (for condonation of delay) The learned counsel for the appellants seeks permission to withdraw this appeal inasmuch as the matter has now been transferred to the South East District, Saket District Courts, New Delhi. She, however, seeks a direction that her application under Order XXXIX Rule 4 CPC, which is pending in the suit, be disposed of at the earliest. The appeal is dismissed as withdrawn with a direction that the application of the appellant under Order XXXIX Rule 4 CPC be disposed of by the concerned Court in the South East District as expeditiously as possible and, preferably, within one month of the first date of hearing.
