At the outset, we have enquired from learned counsel for the petitioner as to whether the petitioner has exhausted the statutory remedy under the Border Security Force Act, 1968 before the filing the present petition against the order dated 31.1.2018 passed by the DIG (North Tripura), retiring him from service on the ground of being unfit. 2.
Learned counsel concedes that the petitioner has not exhausted the statutory remedy and seeks leave to withdraw the present petition, while reserving the right of his client to file a petition before the competent authority against the order dated 31.1.2018.

Leave, as prayed for, is granted. The petition is disposed of along with the pending application.
