% 08.07.2016 Matter has been taken up today as 7th July, 2016 was declared holiday on account of 'Id-ul-Fitr'.
Petitioner seeks parole on the following grounds:- (a) To attend the Barsi of his mother on 12th July, 2016, (b)For changing the school of his son, and (c) To maintain the social ties.
A perusal of the nominal roll shows that petitioner had remained on furlough from 26th October, 2015 to 16th November, 2015; from 24th February, 2016 to 2nd March, 2016 and from 8th April, 2016 to 29th April, 2016. This shows that he has been out of jail for last about seven months,
therefore, plea of maintaining social ties does not appear to be convincing. As regards changing the school of the child is concerned, no reason has been given why it was not done during the period from 8th April, 2016 to 29th April, 2016 during which admissions were stated to be open. That apart petitioner's wife is stated to be capable of taking necessary steps in this regard.
As regards Barsi of mother is concerned, this ground is also not convincing as petitioner's mother died in the year 2011, that is, five years ago.
In view of the above, I am of the opinion that no case for grant of parole is made out, at this stage.
Dismissed.
