During the course of arguments, learned counsel for respondent no.3 points out that this is a misconceived petition; the same relief has been prayed for by the petitioner in CS(OS) No.1075/2000 in which the application of the petitioner under Order 39 Rule 1 and 2 of the CPC already stands dismissed. The Division Bench has also endorsed the order of the Single Judge.

At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw this petition. Permission granted.
