O R D E R
% 01.06.2018 The present petition takes exception to the directions in the order dated 28.02.2018 passed by the Additional Rent Controller on the file of the case (MU - 1/16 - new No. 60642/2016) whereby the order dated 12.08.2016 earlier passed was reviewed and recalled and the prayer made by the respondent in his application under Section 45
(3) of the Delhi Rent Control Act, 1958 was allowed, the petitioner having been directed to restore electricity to the subject premises which is concededly in the tenancy of the opposite party i.e. the respondent.
After some hearing, the counsel for the petitioners submitted that since his contentions about the respondent being in arrears of rent and also about the liability to pay consumption charges have not been taken note of by the Additional Rent Controller, he may be permitted to withdraw the present petition and the applications filed therewith CM(M) 699/2018
and instead be given liberty to move his application for review pointing out the said deficiency and seeking the necessary relief because the order of such nature as aforesaid could not have been unconditional.
The petition and the applications filed therewith are dismissed as withdrawn with liberty as prayed granted.
