% 28.09.2016 By the present petition the petitioner seek quashing of FIR No. 394/2015 under Sections 379 IPC and 135/138 of the Indian Electricity Act registered at PS Jamia Nagar, Delhi on the complaint of authorized officer of Respondent No.2 on the ground that the petitioner has deposited the settled amount and the parties have thus settled the matter. Authorized representative of respondent No.2 Ms. Jaya Thakuria is present in Court and is identified by the learned counsel. She states that pursuant to a settlement the petitioner has deposited the settled amount and a CRL.M.C. 1973/2016
No Due Certificate has been issued to him. Since a No Due Certificate has been issued by the competent authority of respondent No.2, respondent No.2 does not wish to pursue the abovementioned FIR and the proceedings pursuant thereto.
Since parties have settled the matter and no useful purpose would be served in continuing with the trial and there is no legal impediment in quashing the above-noted FIR, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Consequently, FIR No. 394/2015 under Sections 379 IPC and 135/138 of the Indian Electricity Act registered at PS Jamia Nagar, Delhi and proceedings pursuant thereto are hereby quashed. Authorized representative of respondent No.2 has signed this order sheet in acknowledgment of her statements made before this Court. The petition is disposed of. Order dasti.
