W.P.(C) 5795/2016 The present petition has been filed by the petitioner with the following reliefs:

"(a) Issue a writ of mandamus directing the respondent-authorities to regularise his services on the post of Primary Teacher;

(b) Issue a writ of mandamus directing the respondents to consider the claim of the petitioner for regularisation of his services on the existing vacancy and fresh advertisement could be issued inviting applications from the general candidates only for remaining vacancies;

(c) Issue a writ of mandamus directing the respondent to give consequential benefits to the petitioner; (d) Pass such other or further order which this Hon'ble Court may deem fit and proper in the circumstances of the case; and (e) Cost of this proceedings be awarded to the petitioner".

It is noticed that the grievance of the petitioner is against the advertisement issued by the respondent on 28.02.2016 though the same is not filed on record.

Since, the respondents herein are notified under the provisions of Central Administrative Tribunal Act, the remedy for the petitioner is to approach Central Administrative Tribunal. Accordingly, the learned counsel for the petitioner seeks permission to withdraw the present petition.

Accordingly, the petition stands dismissed as withdrawn, with liberty to approach Central Administrative Tribunal. V. KAMESWAR RAO, J JULY 12, 2016/b
