% 02.09.2016 By the preset petition the petitioner seeks anticipatory bail in case FIR No.51/2016 under Sections 498A/406/354/377/506/34 IPC registered at PS Karawal Nagar on the complaint of the wife of the petitioner. The allegations in the FIR against the petitioner are that despite the complainant's parents having spent huge amount of about `20 lakhs in the marriage, the petitioner and his family members were not happy. The inlaws demanded a sum of `15 lakhs and stated that till the demand was not met, the complainant could not live at the matrimonial home happily. She alleged misbehaviour and torture. It is also alleged that though the petitioner BAIL APPLN. 1039/2016

was not a doctor he was represented to be a doctor before his family members. The allegations are of performing unnatural sex and physical assault by belt.

I have perused the MLC of the complainant conducted on 14th February, 2016 which shows old marks including black scar over left side face and right forearm, linear black scar over right forearm and a linear black scar over abdomen above and below the umbilicus. The said scar marks fortify the allegation of the complainant that she was physically assaulted with belt.

Considering the allegations against the petitioner I do not find it to be a fit case for grant of anticipatory bail.

Petition is accordingly dismissed.
