On being enquired about the filing of list of witnesses on behalf of defendant learned proxy counsel is unable to explain and on perusal it is found list of witnesses has not been filed on behalf of defendant and even it has been pointed out by learned counsel for plaintiff that no copy of list of witnesses has ever been supplied to
counsel for plaintiff.
Evidence by way of affidavit be filed by defendant within two weeks with advance copy to plaintiff.
