% 04.06.2018 Crl.M.A. 11322/2018 (Exemption) Application is allowed subject to just exceptions. Bail Appln. 1369/2018 The present application has been filed for the grant of interim bail in FIR No.100/2017, under Section 365/328/302/404/34 IPC, Police Station G.T.B. Enclave.

A similar application was moved before the Court below which was disposed of vide order dated 05.05.2018 vide which the applicant was permitted to undertake the examination in custody and the Superintendent Jail was directed to make the arrangement. It has been submitted that although the petitioner is appearing in the examination from the jail, but the circumstances are not conducive for preparation of the examination.

In the facts and circumstances, this Court is of the considered

opinion that the order passed by the Court below is appropriate and justified.

However, the Superintendent Jail is directed to make suitable arrangement for the applicant/petitioner to make the preparation for the examination.
