Petitioner seeks quashing of FIR No.368/2015 under Section 308 IPC, Police Station Kalyan Puri.

It is contended that the parties are neighbours and reside in a jhuggi.

Subject FIR was registered consequent to a quarrel which took place between the petitioner and the husband of the complainant. The complainant also sustained injuries in the altercation. 3.

Learned counsel for the petitioner submits that the parties have CRL.M.C. 3192/2018

settled their disputes with the intervention of the respectable people of the locality with a view to maintain peace and harmony. The petitioner has also apologised to the respondent No.2. The petitioner also expresses regret in Court.

Respondent No. 2 is present in person and is identified by the Investigating Officer. She submits that she has settled all the disputes with the petitioner. She further submits she does not wish to press her complaint any further.

In view of the fact that disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

In view of the above, the petition is allowed. FIR No.368/2015 under Section 308 IPC, Police Station Kalyan Puri and the consequent proceedings emanating therefrom are, accordingly quashed.
