% 26.10.2018 Learned counsel for the petitioner submitted that the petitioner was not in possession of the contraband and the charge as per Section 29 and 22(c) of The Narcotic Drugs and Psychotropic Substances Act, 1985 could not have been framed. Learned counsel for the petitioner further submitted that he may be allowed to raise this plea before the Trial Court at the time of arguments on the bail application as well as on merits. Learned APP for the State has no objection to the same. Learned counsel for the petitioner submitted that in view of these submissions, he may be allowed to withdraw the present petition with liberty as prayed. Accordingly, the petition is dismissed as withdrawn, with liberty as prayed. CM No.11927/2018 is also dismissed as withdrawn.
