O R D E R

% 01.06.2018 Vide the present petition, the petitioner has sought inter alia a direction to the respondent no.1 to take action against the alleged illegal running of food stall in Shop No.57A, Khan Market, New Delhi, by his younger brother i.e. respondent no.2. Learned counsel for the petitioner submits that the respondent no.2, his younger brother, has been running the said stall without any valid licence from respondent no.1. He further submits that despite repeated complaints having been made to respondent no.1, no action has been taken by the respondent no.1 to even examine the petitioner's complaint wherein the petitioner has clearly brought out that the respondent no.2 is running the food stall without any licence from respondent no.1.

After some arguments, learned counsel for the petitioner,

submits that at this stage, he would be satisfied in case the respondent no.1 is directed to consider both his representations dated 23rd October, 2017 and 17th April, 2018, and pass a reasoned and speaking order thereon in a time bound manner after examining whether the respondent no.2 has a valid licence or not.

Learned counsel for the respondent no.1 who appears on advance notice, does not oppose the limited prayer made by the petitioner.

Accordingly, the respondent no.1 is directed to consider the petitioner's aforesaid two representations and pass a reasoned and speaking order thereon within a period of eight weeks from today. In case the petitioner is aggrieved by any order passed by respondent no.1, it will be open for the petitioner to take legal recourse as permissible under law.

The petition and application are disposed of in the aforesaid terms.
