O R D E R

% 01.06.2018 Vide the present petition, the petitioner has sought a direction to respondent nos.1 & 2, to issue a direction to all private schools including minority schools to open their sports facilities and physical education training after the regular school hours for outside students at nominal fee. The petitioner is in particular seeking a direction to respondent no.3 i.e. St. Xavier's Senior Secondary School, to impart physical education for swimming from the next session of 2019-20, to the petitioner, his brother and other similar situated students. After some arguments, learned counsel for the petitioner concedes that though he is seeking a direction to respondent nos.1 & 2, he has not even approached the Directorate of Education with any such request. He, therefore, seeks leave to withdraw the present

petition with liberty to make a comprehensive representation to the respondent nos.1 & 2. He, however, prays that respondent nos.1 & 2, be directed to decide the representation in a time bound manner. Ms.Takiar, learned counsel who appears on advance notice for respondent nos.1 & 2, does not oppose the aforesaid course of action. Accordingly, the petitioner is granted liberty to make a representation to the respondent nos.1 & 2 within a period of one week.

Upon the petitioner making such a representation, the respondents will decide the same within six weeks. Needless to say, in case the petitioner is aggrieved by the order passed by the respondent, he will be at liberty to take legal recourse as permissible under law.

The writ petition and application are dismissed as withdrawn with liberty as prayed for.
