% 01.06.2018 Vide the present petition, the petitioner has sought a direction to the respondents, to promote her to Class IV and include her name in the digitized official records and allow her to attend and appear in the examination of Class IV at par with other Class IV students. Learned counsel for the petitioner submits that the petitioner, who was born on 19th July, 2010, was enrolled in class Nursery at the young age of three years and eight months in March, 2014 and based on her exemplary performance in the last four years, she was to be promoted to Class IV in March, 2018. She further submits that though the petitioner was initially permitted to attend Class IV for a
few days, the respondents had initially not even given her the Report Card of class III and the petitioner was verbally told by the teacher and the Principal that she will not be allowed to attend Class IV. She further submits that it is only recently that the petitioner has been handed over the report card for Class III.
On the other hand, Mr.Ajay Digpaul, learned counsel who appears on advance notice for respondent nos.1 & 2, submits that he has instructions to state that the petitioner was duly permitted to attend Class IV and she has neither been harassed nor will be harassed in any manner. He further assures the Court that the respondents will permit the petitioner to attend Class IV in all the relevant examinations at par with the other Class IV students of the School. In view of the statement made by learned counsel for respondent nos.1 & 2, nothing survives for adjudication in the present petition.
The petition and pending applications are disposed of in the aforesaid terms.
