% 01.06.2018 The present contempt petition has been filed by the petitioner alleging non-compliance of order dated May 21, 2018 in W.P.(C) No. 3398/2018, when this Court on an undertaking given by the petitioner recorded the submission made by the counsel for the NDMC that the property shall be desealed by 3 pm next day i.e. May 22, 2018. Mr. Kapil Dutta, learned counsel appearing for the respondents state that the same has not been de-sealed as there are certain misuser charges to be paid by the petitioner. Mr. Rakesh K. Khanna, Ld. Sr. Counsel disputes the misuser charges. Suffice to state, this aspect was not brought to the

notice of this Court when the order dated May 21, 2018 was passed. Since a statement has been given by the counsel for the NDMC to de-seal the property on next day at 3 pm, the respondent shall de-seal the property during the course of the day.

The respondents are at liberty to communicate the misuser charges to the petitioner. Liberty is with the petitioner, if aggrieved to seek such remedy as available in law. The contempt petition is closed. V. KAMESWAR RAO, J JUNE 01, 2018/ak
