% 24.08.2017 Counsel for the petitioner has submitted that the petitioner is a consumer of the BSES, K. No. RJ 160714SC056.

He submits that petitioner has settled the matter amicably with BSES Rajdhani Power Ltd./respondent No.3 and the bill raised was Rs. 1,68,504.34/- and the settlement amount of Rs.1,51,700/- has already been paid. Counsel for the petitioner has further submitted that since the matter has been settled with the respondent No.3, the present FIR No. 906/2014, under Section 135 of the Indian Electricity Act, 1910 registered at Police Station, Jamia Nagar and under Section 379 IPC be quashed. Mr.Raghav Chadha, counsel for respondent No.3 has admitted that the settlement amount has been deposited by the petitioner and nothing remains to be adjudicated further qua the said FIR.

Looking into the above facts and circumstances, since the matter is settled between the petitioner and the BSES Rajdhani Power Ltd./respondent No.3 and the settlement amount has already been deposited, in the interest of justice, FIR No. 906/2014 under Section 135 of the Indian Electricity Act, registered at Police Station-Jamia Nagar and under Section 379 of IPC and all proceedings emanating therefrom are quashed.

The present petition is disposed of accordingly. A copy of the order be given dasti to the parties, as prayed. I.S.MEHTA, J AUGUST 24, 2017 mw
