% 30.07.2018 Though undoubtedly, the Sessions case against the petitioner has taken long time to conclude, it relating to FIR no.375/2009 under Sections 302, 120 B IPC and Section 25 of Arms Act, the petitioner being in jail since 21.09.2009, the counsel for the petitioner fairly conceded that the trial court has been making all efforts to expedite the process, the case now being almost at the concluding stages where the investigating officer remains to be examined. The Sessions court which was moved earlier for release on bail has rejected the application by order dated 26.05.2018. The said order would reveal that there is evidence to show that the petitioner had used an improvised fire arm for committing the offence of murder. BAIL APPLN. 1366/2018
Having regard to the facts and circumstances of the case, release of the petitioner at this stage of the process will not be correct. This court refrains from recording any expression of opinion on the merits of the case so that it does not prejudice either side. The petition and the application filed therewith are dismissed.
