% 30.05.2016 With the consent of the learned counsel for the parties the matter can be disposed of after directing the learned counsel for the appellant who has expressed her apprehension that if the appellant ultimately succeeds in her plea to establish that appellant was not liable to pay rent to the respondent then she will not be able to recover the money from the respondent.
In order to allay the fears of the appellant, the respondent shall file an undertaking to this court that the respondent shall abide by the orders of the trial court which it may be finally passed. A copy of this undertaking shall be filed before the trial court on or before the next date of hearing and a copy be supplied to the appellant also.
It is directed that subject to furnishing of the aforesaid undertaking by the respondent the amount which is deposited by appellant with the Registrar General shall be released to the respondent.
With these directions, the learned counsel for the appellant as
has not pressed, the appeal and all the pending applications along with the application under Order 7 Rule 11 CPC be disposed of expeditiously.
The parties shall be free to raise all such pleas which may be available to them in law.
Copy of the order be given dasti to learned counsel for the parties and copy of the order be also sent to the learned trial court. V.K. SHALI, J.
