O R D E R

% 19.09.2017 Learned APP submits that petitioner conspired with the other coaccused, pursuant whereof jewellery worth `1.76 crores was robbed by the co-accused near Liberty Cinema, Karol Bagh. Three young boys had come on the motorcycle, overtook the taxi of complainant, stopped it and robbed him of bag containing jewellery. The CCTV footage taken from premises of Hitech towards Netaji Subhash Place was collected and shown to complainant, who identified the petitioner. He further submits that offence alleged against the petitioner is serious in nature and he should not be enlarged on bail.

Learned counsel for the petitioner submits that petitioner is in custody

for about three years. The CCTV footage is not of the spot but of the place which was 6/7 kms. away, inasmuch as it relates to the recording done at 3.00 p.m; whereas the alleged incident took place at 7.30 p.m. at Karol Bagh. The call details of the petitioner was obtained by the police which shows his presence at Geeta Colony at 7.15 p.m. Geeta Colony is about 15 kms. away from the spot. Complainant has also not identified the petitioner in Court.

Keeping in mind the totality of the facts and circumstances detailed above, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
