Defendant No.3/applicant has admittedly filed written statement to the suit of plaintiff within 120 days from the date of service of summons. Accordingly, instant application filed by defendant No.3 is hereby allowed. Written statement already filed by defendant No.3 is directed to be taken on record. IA stands disposed of.

CS(COMM) 968/2018 Let replication to the written statement of defendant No.3 alongwith affidavit for admission/denial of documents be filed by plaintiff within four weeks with advance copy to counsel for

defendant.

Replication to the written statement of defendant No.1 filed by plaintiff. Thus, pleadings qua defendant No.1 is complete. Defendant No.2 has failed to file affidavit for admission/denial of documents till date despite more than sufficient time and opportunity given to him. Learned counsel for defendant No.2 submits that affidavit for admission/denial of documents has already been filed vide diary No. 373008. Same is not on record. As per office report, said affidavit for admission/denial of documents has been returned under objections. Counsel for defendant No.2 to check up with the registry, remove the objections and get the affidavit for admission/denial placed on record within a week. Renotify for completion of pleadings and marking of exhibits to the documents on 13.03.2019.
