% 18.01.2017 C.M. No.43900/2016 This Court notes that this petition has been disposed of on 18.7.2016 by a speaking order. This order was passed in the presence of the petitioner. The petitioner has thereafter moved an application which had not been prosecuted by the petitioner. The Court was constrained to dismiss that application in default as also for nonprosecution. This was on 28.11.2015. On the said date counsel for the petitioner/applicant had put in appearance. He had sought a recall of the order.

Registry has now reported that notice could not be issued as process fee was not filed. The lackadaisical attitude of the applicant bordering on negligence is writ large. This Court is not inclined to

entertain this application noting the fact that the petition already having been disposed of by a speaking order, this application is dismissed.
