O.M.P.(I) (COMM.) 253/2018 & I.A. No.8122/2018 Learned counsel for the respondents who appears on advance notice brings to my attention a copy of the notice dated 20.06.2018 issued by the Sole Arbitrator appointed by the parties for adjudicating the disputes that have arisen between them. He further submits that the respondents have already consented to the appointment of the Sole Arbitrator. As far as the interim relief is concerned, learned counsel for the respondents submits that as the hearing has been fixed by the Arbitrator on 14.07.2018, the respondents would in the meantime not dispose of or destroy any tools and also remove the Facebook Post which has been annexed in the petition at
pages 35 and 36. This statement is however, without prejudice to the rights and contentions of the respondents and shall be a matter to be adjudicated by the Arbitrator on an appropriate application under Section 17 of the Arbitration and Conciliation Act, 1996 being filed by the parties. In view of the above, the present petition and pending application are disposed of, with no order as to cost.
