The present appeal has been filed by the Appellant - Lakhan under Section 374(2) of the Code of Criminal Procedure, 1973 against the judgment and order on sentence dated 14th January, 2011and 28th January, 2011respectively passed by ld. Additional Sessions Judge, Dwarka Courts, Delhi, in Session Case No. 10/10 arising out of FIR No. 07/2010 registered under Section 376/506/342 IPC.

The Appellant was convicted under Section 376 and 506 IPC. It is submitted that the Appellant was released from jailon 2nd January, 2017 after completing the sentence awarded to him.

The Appellant states that he does not wish to press this appeal on the ground that it has become infructuous as he has already served his sentence. 5.

Keeping in view the statement of the Appellant, which is taken on record, and the fact that the appellant has already served the sentence awarded by the Trial Court, the present appeal is disposed of as not pressed. 8.
