In view of the fact that no details are given in the present suit, as required under Order 6 Rule 4 CPC, as to how the mother of the plaintiffs-Smt. Kanta Kumari was the owner of the suit property bearing Municipal No. CP-169, Maurya Enclave, Pitampura, New Delhi-110034 and Smt. Kanta Kumari is stated to have died intestate, counsel for the plaintiffs seeks liberty to withdraw the suit so as to file a fresh suit thereby giving all necessary particulars of ownership of the mother-late Smt. Kanta Kumari by means of unimpeachable documents, including title documents so that plaintiff can claim share by partition to the property of the mother-late Smt. Kanta Kumari who has died intestate.
