O R D E R

% 21.04.2016 After some arguments, it has been agreed that the suit property shall be vacated by the petitioner on or before 31.12.2016. This submission has been made by learned counsel for the petitioner-tenant under instructions from his client present in Court. Accordingly, the suit property i.e. the Shop No.B-130, Ground Floor, S.P.Mukerjee Market, Rani Jhanshi Road, near Petrol Pump, Delhi shall be vacated by the petitioner on or before 31.12.2016. Needless to state that at the time of handing over vacant and peaceful possession of the suit property to the landlord all electricity and water charges shall be cleared by the petitioner-tenant. The user charges shall be continued to be paid at the admitted rate which is stated to be Rs.800/- per month. The user charges/rent in this intervening period shall be paid on or before 7th day of each english calendar month. Arrears, if any, shall also be cleared within a period of four weeks from today. All these facts shall be

incorporated in an affidavit of undertaking to be filed in Court by the petitioner-tenant within a period of two weeks from today with advance copy to the landlord failing which the landlord will be at liberty to execute the decree.

With these directions, petition disposed of.
