O.M.P. (E) (COMM.) 22/2016 On 6th May, 2016, summons were issued for appearance of the concerned Court official from the Court of Civil Judge (JD) and Metropolitan Magistrate (West), Jaipur Metropolitan, Jaipur for appearance before the learned Arbitrator on 14th May, 2016. Learned counsel for the petitioner states that the said witness could not appear possibly for the reason the summons to the said witness were issued by the registry through ordinary process only on 10th May, 2016.

Learned counsel for the petitioner also states that the criminal case arising out of a FIR no.63/2013 is now pending before the Court of Civil Judge (JD) and Metropolitan Magistrate (West), Jaipur Metropolitan, Jaipur. In other words, there is a change of Court which is dealing with the criminal case arising out of a FIR no.63/2013. He states that the learned Arbitrator vide his order dated 14th May, 2016, has granted approval under Section 27 of the Arbitration and Conciliation Centre to summon the concerned official of the Court dealing with the criminal case being FIR no.63/2013 i.e. the Court of Civil Judge (JD) and Metropolitan Magistrate (West), Jaipur Metropolitan, Jaipur.

Let dasti summons be issued for appearance of the concerned official of the Court of Civil Judge (JD) and Metropolitan Magistrate (West), Jaipur Metropolitan, Jaipur before the learned Arbitrator on 3rd June, 2016 at 11.00 am at the Conference Room, Holiday Club, Panchsheel Enclave, New Delhi110017 with relevant record. The summons shall be accompanied by the copy of the petition.

The petition is disposed of.
