W.P. (Crl.) 2869/2016 At the relevant time, petitioner was tenant of respondent no.2. Present FIR 1583/14 under Sections 428/468/471 IPC was registered against the petitioner at police station Rajouri Garden, on the complaint of respondent no.2. It is alleged in the FIR that petitioner got the electricity connection from BSES Rajdhani by producing forged Rent Agreement, Rent Receipts
etc.
Learned ASC for the State submits that investigations are still going on.
Respondent no.2 is present in Court and has been identified by SI Mohinder Singh of police station Rajouri Garden. Respondent no. 2 submits that he has settled the matter with the petitioner on the terms and conditions as stipulated in the Memorandum of Understanding dated 23rd December, 2014.
Respondent no.2 further submitted that he has already received `40,000/- from the petitioner. He further submits that he is not interested in pursuing the FIR any further and the same may be quashed. Keeping in mind that present FIR is an outcome of disputes between the landlord (respondent no.2) and tenant (petitioner) which they have settled amicably, no fruitful purpose would be served in keeping them entangled in criminal proceedings. Accordingly, in the interest of justice, FIR 1583/14 under Sections 428/468/471 IPC registered at police station Rajouri Garden, which is at investigation stage, is quashed. Writ petition is disposed of in the above terms. A.K. PATHAK, J.
