This appeal is disposed of with the consent order that the rate of interest granted by the trial court is enhanced from 4% to 12% per annum simple. The respondents will now deposit the amount as decreed by the trial court alongwith interest at 12% per annum from 1.4.2004 till the date of deposit within a period of four weeks from today. 2.

As also agreed costs imposed by the trial court upon the respondents are reduced by 50% and therefore costs which will now be payable to the appellant by depositing the amount of costs in court will be a sum of Rs.21,700/-. This additional amount be deposited by the respondents in the

trial court within a period of four weeks from today. The amount to be deposited by the respondents in terms of the present order in the trial court, will be in the form of FDR drawn up in the name of all the appellants.
