By the present petition, the petitioner has sought quashing of complaint case being CC No.369/3/2016 titled as 'Registrar of Companies vs. M/s Green Infra Wind Power Theni Ltd.' pending adjudication before the learned ACMM, Tis Hazari Courts.

When the matter came up for hearing on 27th July, 2016, learned counsel for respondent pointed out that no reply to the show cause notice was filed by the petitioner and the documents relied upon having not been filed with the Ministry of Corporate Affairs, the same could not be considered.

Learned counsel for the petitioner stated that he would like to make a detailed representation to the respondent. Thus the matter was adjourned. 4.

Today learned counsel for the petitioner states that his representation to the Ministry of Corporate Affairs, Government of India has been accepted and vide communication dated 7th November, 2016 it has been informed that the competent authority has approved for withdrawing the above noted complaint case.

Learned counsel for the Union of India/ROC on instructions from Mr. Arvind Kumar, Assistant Director (Cost), Ministry of Corporate Affairs admits having written a letter dated 7th November, 2016 to the Registrar of Companies with copy to the petitioner for withdrawing the above noted complaint.

In view of the letter dated 7th November, 2016 received and the statement of Mr. Arvind Kumar, Assistant Director, who is present in Court, learned counsel for the petitioner does not press the present petition and the application.

Petition and application are dismissed as not pressed. MUKTA GUPTA, J.
