Vide order dated 17.5.2016, the Joint Registrar has listed the matter in Court as plaintiff is not properly prosecuting the suit by leading evidence. Plaintiff has taken three opportunities to file certified copies of the documents in support of the affidavit by way of evidence but the same was not done.

No one appeared before the Joint Registrar on 17.5.2016 on behalf of the plaintiff.

No one appears for the plaintiff even today in this Court.

In view of the above, the suit is dismissed in default and for non-prosecution.

Let no application for restoration or recall of this order be entertained by the Registry of this Court unless costs of Rs.20,000/- are first

paid to the defendant no.1.

In regards to costs I exercise power under Order 25 read with Section 141 CPC, and by which latter provision Order 25 CPC will mutatis mutandis apply also to interim proceedings. VALMIKI J.
