% 16.09.2016 By the present petition the petitioner seeks interim bail for a period of one month in case FIR No. 144/2013 under Sections 302/34 IPC registered at PS Vijay Vihar on the ground that he had to look after his wife and the newly born child. This petition came up before this Court on 23rd May, 2016 and notice was issued returnable for today. As per learned APP for the State the wife and the newly born child of petitioner are safe and sound and are living with the brother of the petitioner and other family members. Learned APP further submits that after the FIR was registered the petitioner could not be arrested and thus he was declared PO. In the meantime co-accused was acquitted where after the petitioner surrendered.

Considering that the factum of birth of the child of the petitioner has been verified and the petitioner has to make some financial arrangements for the wife and the child and he has been in custody for nearly one year now, I deem it fit to grant interim bail to the petitioner for a period of one month. It is directed that the petitioner be released on bail for a period of one month from the date of his release on his furnishing a personal bond in the sum of `20,000/- with one surety of the like amount which surety will be a family member of the petitioner subject to the satisfaction of the learned Trial Court.

Petition is disposed of. Order dasti.
