The petitioner has filed the present petition, inter alia, praying that directions be issued to respondent no.2 (Food Safety and Standard Authority of India - FSSAI) to grant product approval in favour of the petitioner for an energy drink - 'Royce Energy Drink'.

The learned counsel appearing for FSSAI submits that if the petitioner applies for product approval under the Food Safety and Standards (Food Product Standards and Food Additives) Regulation, 2011, the petitioner's application would be duly considered and disposed of within a period of three months from the application being made. 3.

FSSAI is bound down to the aforesaid statement and shall process the petitioner's claim for product approval within the specified period.

It is seen that the petitioner had also paid a sum of ₹25,000/-. The respondent would also give due credit for the fees already deposited. 5.

It is also contended on behalf of the petitioner that the application has been unduly delayed while product approvals with regard to the other products have been granted and, therefore, necessary compensation be given. This Court is inclined to entertain the aforesaid request in these proceedings.
