% 20.05.2016 Crl.M.A. 8326/2016 (Exemption) Application is allowed subject to just exceptions. Crl.M.C. 1966/2016 & Crl.M.A. 8325/2016 (Stay) The present petition has been filed by the petitioner under Section 482 Cr.P.C.

It has been submitted that earlier a petition bearing Crl.M.C. 1080/2016 was filed by the petitioner in which vide order dated 06.04.2016 the notice was issued to the respondent for 07.09.2016 and it was directed that the Trial Court shall not pass final judgment in the case. Now the present petition has been filed mentioning that witness Anand Srivastava was summoned but he did not appear before the Trial Court on 27.04.2016 and his exemption application was allowed for that day only. The ground taken by the petitioner is that if the statement of witness Anand Srivastava is recorded, it will

affect the main petition.

The present petition is disposed of with the observation that evidence recorded in the matter before the Trial Court is the subject matter of the decision of the pending petition. The present petition and application Crl.M.A. 8325/2016 are disposed of accordingly.
