% 13.02.2019 During the course of the arguments the learned counsel for the petitioner submits he would not challenge the impugned order on merits if the petitioner is granted three years time to vacate the premises, though the learned counsel for the respondent has agreed only for six months.
In the circumstances it is directed and as agreed the petitioner shall vacate the premises on or before 31.08.2020 and shall hand over the vacant and peaceful possession of the premises to the respondent herein.
The petitioner shall also pay the user/occupation charges at the rate of Rs.3,000 per month w.e.f. June, 2018 till vacation of the premises. The arrears shall be paid @ Rs.3,000/- per month alongwith Rs.3,000/- per month user charges till the arrears are cleared. The amount shall be payable by the 7th day of each calendar month. The
electricity and water charges shall be paid as per actuals. Usual undertaking shall be filed by the petitioner herein within four weeks from today. Any violation of the undertaking shall entail eviction forthwith.
