% 29.03.2016 Present writ petition has been filed primarily seeking a direction to Central Vigilance Commission to initiate departmental enquiry/proceeding against government officials who are stated to be responsible for poor quality of construction work in Rohini Chambers Block. In the counter-affidavit filed by respondent nos. 1 and 2 it has been averred that the construction work was executed by respondent no. 3Contractor as per the contract entered into between the parties and as per the drawings approved by the client department.

It is also averred in the counter-affidavit that there were only some minor leaks and cracks which have been rectified and repaired. Keeping in view the aforesaid averments in the counter-affidavit, this Court is of the view that serious disputed questions of fact arise for

consideration, without adjudication of which, no relief can be granted in the present writ petition.

Consequently, present writ petition is disposed of with liberty to petitioner to file appropriate legal proceedings in accordance with law. MANMOHAN, J MARCH 29, 2016 rn
