% 05.12.2017 By the appeal moved, the petitioner seeks restoration of the petition which was dismissed for laches, acquiescence and waiver as per order dated 30.10.2017.

The counsel for the appellant has been heard. There are no reasons explained for the inordinate delay in the petition being preferred three and half years‟ after the eviction in execution of the order of the Rent Controller and after more than one and half years‟ of the impugned order being passed.

The application is accordingly dismissed.
