Mr. Rohtas Kumar Jijoria, Advocate appears and states that he has been engaged in this matter and seeks adjournment. He has handed over his Vakalatnama in the Court which is taken on record. 2.
Mr. Rohtas Kumar Jijoria has been informed that his engagement even if at the last minute is no ground for adjournment and he ought to have come prepared.

This petition of the year 2008 cannot be kept pending in this fashion. 4.
Mr. Rohtas Kumar Jijoria, Advocate then states that the earlier counsel for the petitioners has become a counsel for Union of India. 5.
On enquiry it is informed that Mr. P.K. Mishra was the earlier counsel.

The counsel for the respondents draws attention to the order dated 1st September, 2016 when Mr. P.K. Mishra had made the same request and CM(M) No.31/2008
sought adjournment.

It is quite evident that the petitioners do not want to proceed with the petition. Even the cost which was imposed as a condition for adjournment on 21st July, 2017 has not been paid.

Dismissed for non-prosecution.
