By way of this writ petition filed under Article 226 of the Constitution of India read with Section 482 of Cr.P.C., petitioner is impugning the order dated 15th September, 2015 passed by GNCT of Delhi whereby his prayer for grant of parole for a period of three months on the ground of new construction of his house after demolishing the old construction was rejected.

Ms.Sumi Anand, Advocate appearing on behalf of Mr.Avininder Singh, A.S.C. for the State accepts notice of this writ petition and submits that after rejection of the impugned order dated 15th September, 2015, petitioner has been released on furlough w.e.f. 19th March, 2016 to 3rd April, 2016 granted to him by DG(P).

As per Parole/Furlough Guidelines-2010, a minimum period of six W.P.(CRL) 1779/2016
months ought to have elapsed from the date of termination of the previous parole/furlough.

In the given facts and circumstances, the prayer of the Petitioner for releasing him on parole is hereby rejected.

Accordingly, the writ petition is dismissed.
6.
Petitioner be informed through concerned Jail Superintendent about the orders passed.
