% 12.04.2018 It is submitted that the Indian Roads Congress (IRC) has convened a meeting with the appellant to consider its claim for issuance of marketing license for the product in question and for renewal of accreditation. It is, therefore, submitted that the appeal may be permitted to be withdrawn with liberty to approach the Court at a later date in case of any rejection.

In the light of the statement made, in case the IRC decides to reject the request for accreditation, it is open to the appellant to approach this Court. Further, that would constitute a fresh cause of action. The appeal is accordingly dismissed as withdrawn along with the pending application.
